Do You Need a Property Lawyer to Buy a House in Queensland?

While it is not a legal requirement to engage a property lawyer to sell or purchase a property in Queensland, it is strongly recommended that you obtain independent legal advice before the sale or purchase of real estate.

From 20 February 2023, Land Title Regulation 2022 (Qld) introduced an eConveyancing mandate requirement for certain title instruments to be lodged via an Electronic Lodgement Network Operators (ELNOs)1 platform, unless a valid exemption applies. These requirements mean that legal professionals, financial institutions and eligible entities will need to subscribe and use ELNOs for certain required instruments to conduct a property transaction.

Given the complexities of property law and property transactions, engaging a property lawyer is highly recommended.
