What is a Seller’s Disclosure Statement?
Our team at HTW Legal Group have extensive experience in conveyancing.
A Seller’s Disclosure Statement is a legally required document that includes key information about the property which could potentially impact a buyer’s decision to proceed with the purchase.
Effective 1 August 2025, it is compulsory for property sellers (residential and commercial) in Queensland to provide a compliant Seller’s Disclosure Statement, along with the prescribed certificates, to the buyers before signing a contract of sale.
HOW LONG DOES IT TAKE TO PREPARE YOUR SELLER DISCLOSURE STATEMENT?
We have been involved in everything from local residential developments through to large-scale commercial developments.
Depending on the documentations you have available to assist us with the preparation, it may take 1 week to complete the Seller Disclosure Statement.
If we are required to prepare the Seller’s Disclosure Statement without any documentation from you, the process with ordering relevant searches could take up to 2 weeks from the time of engagement.
As these timeframes are a general guideline, we strongly recommend you reach out to us immediately once you have engaged a real estate agent to market and sell your property.
EXCEPTIONS TO THE PROVISION OF SELLER DISCLOSURE STATEMENT
With in-depth knowledge of both residential and commercial property transactions, we manage every stage of the conveyancing process with efficiency.
There are, however, some exceptions where a Seller Disclosure Statement is not required, such as:
- Related party transactions, where the buyers are able to waive compliance before signing the contract, such as the sales between co-owners or transfers pursuant to a will
- Property sales price exceeds $10,000,000, and the buyer waives compliance
- Boundary realignments between neighbouring owners
- A contract where the State or government body is the buyer
- A contract that gives effect to a court order, enforcement warrant or a financial agreement under the Family Law Act 1975 (Cth)
- Off the plan sales, which will continue to be governed by the Land Sales Act 1984 (Qld) and Body Corporate and Community Management Act 1997 (Qld)
