Conveyancing is the legal process of transferring ownership of a property from one party to another, whether it be in the form of a person or entity. In Queensland, this process is governed by the Property Law Act 2023 (QLD).
A conveyancer is a professional specialising in property ownership transfer but is unable to provide legal advice. In Queensland, they handle most of the behind-the-scenes conveyancing process.
A conveyancing lawyer, or property lawyer, is a legal practitioner who specialises in matters related to all aspects of property law.
They manage the conveyancing tasks and offer comprehensive legal advice on residential and commercial conveyancing, complex property transactions, and provides representations for dispute and litigation matters if the needs arise.
In Queensland, while you may have the option to DIY your conveyancing, any paid conveyancing work can only be undertaken by a conveyancing lawyer.
We recommend that a conveyancing lawyer be appointed even before signing the contract of a property purchase or sales.

A cooling off period is a set timeframe after exchanging sales contract where a buyer can withdraw from a property purchase without significant penalties.
Under the Property Occupations Act 2014 (Qld), buyers are entitled to a five business day cooling off period, which starts on the day that the buyer or the buyer’s agent received the signed contract and ends at 5:00pm on the fifth business day.
If a buyer chooses to terminate the sales contract during the cooling off period, the seller is entitled to retain a termination penalty of up to an equivalent of 0.25% of the purchase price from the deposit paid. The balance of the deposit must then be refunded to the buyer within fourteen days of the termination.
There are however some exceptions to the applicability of cooling off periods, in particular, buyers who purchase a property at an auction are not entitled to a cooling off period.
In Queensland, transfer duty, previously known as stamp duty, is a tax imposed on dutiable transactions, such as for the transfer of dutiable property.
The amount of transfer duty payable is calculated a sliding scale, meaning the higher the purchase price is, the greater the amount of transfer duty payable.
The amount of transfer duty payable may be further reduced by exemptions and concessions made available under the Queensland Government legislation at the current time.
